WRC rejects general operative’s unfair dismissal complaint

The WRC dismissed a general operative’s unfair dismissal complaint, finding the food company had reasonably considered alternative work and that he remained unfit for normal duties. The decision was dated 7 June 2017. The worker said the company failed to consider other roles or redesign his job. The company said his work required physical capability and that suitable sedentary duties were unavailable. The adjudicator found substantial medical evidence had been gathered and shared with the worker, who had an opportunity to comment. He was satisfied the company had reasonably explored alternatives given the size and nature of its business. The complaint was not well founded.
