WRC rejects food assistant’s constructive-dismissal claim; three complaints withdrawn

By Saoirse Doyle

Workplace Relations Commission ·

The Workplace Relations Commission found a food assistant’s constructive-dismissal complaint against a public house not well founded. The decision was dated 12 December 2016. She alleged bullying after bringing a personal-injury claim, reduced hours after sick leave and unpaid holiday pay. The WRC found her average hours increased after she returned, that she had agreed to repay a loan, and that there was no evidence supporting the bullying allegation. Her contract-information and road-transport complaints were withdrawn, as was her Payment of Wages complaint, which had been treated as part of the unfair-dismissal case.
