The WRC rejected a forklift driver’s complaints of health-and-safety penalisation and disability discrimination in a decision dated 29 November 2017. The driver had reported defective cement-mixer cleaning equipment, which the adjudication officer found was a protected act, but the officer found his fixed-term contract ended because of performance issues. The officer also found that the supplier had not discriminated in dismissing the driver and had followed the physiotherapist’s recommendation for light duties. Both complaints were not upheld.
