WRC awards restaurant worker €11,960 over bullying and harassment

Workplace Relations Commission ·

The Workplace Relations Commission upheld an employee’s bullying and harassment complaint against a restaurant and awarded €11,960 compensation. It also awarded €823 in wages and €1,000 compensation over Sunday pay. The decision was dated 24 April 2017.

The employee said a director shouted at him and behaved inappropriately in the kitchen. The restaurant did not attend the hearing. The officer found that the behaviour was not addressed and that the employer had no appropriate grievance or bullying and harassment procedures. The employee left his job after an incident that he found upsetting and embarrassing.

The employee also said he worked nearly every Sunday without a premium. The officer found he had been paid at the basic rate, and awarded €823 in wages using a 10% premium calculation for 100 weeks. A further €1,000 was awarded for the breach of legislation. The restaurant’s absence did not prevent the officer from deciding the complaints on the evidence presented.
