A data analyst found to be an employee was awarded €2,176 for annual leave and public holidays by the Workplace Relations Commission. Adjudicator Patsy Doyle dated the decision 14 June 2017. The worker said she worked set hours under the company’s direction, followed its policies and had no tools of her own. The company said she was engaged as a contractor. The adjudicator found that the reality of the relationship made her an employee from November 2014, and recommended €3,000 compensation for misclassification if the parties accepted the recommendation. The worker’s complaint about unpaid annual leave and public holidays succeeded for the six-month period considered. Her Payment of Wages complaint about increased hours was outside the time limit and was not well founded; the merits were not decided. Its separate leave and holiday element was also not well founded, with that claim dealt with under the Working Time Act.
