WRC rejects estimator’s constructive dismissal complaint

By Eimear Byrne

Workplace Relations Commission ·

The WRC found that an employee’s constructive dismissal complaint was not well founded. Adjudication Officer Michael Hayes dated the decision 16 February 2018. The employee said changes to his duties, a failed grievance and a disciplinary warning left him no alternative but to resign. The employer said he resigned because a promotion was unavailable and argued that it had acted reasonably in using its disciplinary process. The WRC found he had not shown that the employer acted so unreasonably that he was entitled to end his employment, or that his resignation was reasonable in the circumstances.
