The WRC dismissed a restaurant manager’s constructive unfair dismissal complaint in a decision dated 11 May 2017. He said the new owner verbally abused him, restricted cigarette breaks and removed some of his duties. The restaurant said an argument followed the owner’s request that breaks not be taken during busy service, and that the manager later resigned. The Adjudication Officer found the key events were concentrated in a short period, the restaurant sought the manager’s return and offered a grievance process, and he did not use that process before resigning.
