The WRC awarded a public house assistant manager €500, €250 and €500 in redress for TUPE breaches after a business transfer. The decision was dated 24 October 2017. The assistant manager said the new employer failed to preserve his employment terms, provide information and consult him, and that its conduct forced him to resign. The adjudication officer found technical breaches concerning transferred terms, employee representation and information or consultation. The constructive dismissal complaint failed: the 16-day transition did not establish a fundamental breach or the required unreasonable conduct. Two working-time complaints and a TUPE dismissal complaint also failed. A wages complaint was withdrawn as settled. Two other TUPE complaints succeeded but received no additional redress beyond related awards.
