The Workplace Relations Commission awarded an electrical technician €3,000 after finding his contract provided for an annual salary of €46,000, while the employer paid him at a rate of €42,000 for nine months. The decision was dated 6 December 2016.
The technician relied on an emailed contract and supporting messages. The employer said the agreed salary was €42,000, argued the higher-salary contract was sent in error and disputed his entitlement to a lunch allowance. The adjudicator found the technician’s contract was the genuine one and that the shortfall was an unauthorised deduction under the Payment of Wages Act.
