A driver’s complaints against a Road Haulage Company over notice pay and unfair dismissal were rejected by the Workplace Relations Commission. Adjudication Officer Joe Donnelly dated the decision 19 September 2017. The driver said his manager told him to go home and leave his company phone, then agreed a €4,000 settlement that was later cancelled. The company said he had not been dismissed, his job remained open and he breached the settlement agreement. The adjudicator found that the driver voluntarily signed an agreement ending his employment in return for payment. The dispute over the agreement was outside the WRC’s remit, and notice pay was not due. The Payment of Wages complaint was not well founded, the unfair dismissal claim failed because he had voluntarily ended his employment, and his separate complaint about written terms was withdrawn at the hearing.
