The Workplace Relations Commission found a sales distributor was engaged on a contract for service and had no standing to pursue four complaints against a bread manufacturer. The decision was dated 30 November 2017. The distributor said he had worked for the company for 28 years and was integrated into its sales team. The company argued that he ran his own distribution business. The adjudicator cited his leased premises, commission-based pay, the company’s limited control over sales and dispatch, and his employment of his own worker. The complaints concerned unfair dismissal, terms of employment and working time; the merits were not decided.
