The Workplace Relations Commission awarded a courier €10,500 after finding he was unfairly dismissed by a delivery provider. Adjudication Officer Penelope McGrath dated the decision 22 August 2017. The courier worked for the company from August 2014.
After a heated meeting with a co-owner, the employer said the courier had resigned. The courier said he left after being told by phone to leave his job. The adjudicator found the employer had terminated his employment and that the dismissal was unreasonable and unfair.
The award took account of evidence about mitigation and the adjudicator’s view that the courier appeared to have allowed the situation to escalate. His Payment of Wages and Organisation of Working Time complaints were withdrawn during the hearing, on the understanding that the amounts involved would be included in his final paycheque.
