WRC declines jurisdiction over five doctors’ employment terms complaints

By Donal Gilhooly

Workplace Relations Commission ·

The WRC declined jurisdiction over five doctors’ complaints seeking written terms of employment because the adjudication officer could not determine whether they were employees. The decision was dated 15 August 2016. The doctors said they worked under contracts of service and sought written confirmation of their employment status and terms. The health provider denied that they were its employees. The officer said the Terms of Employment (Information) Act did not empower an adjudicator to decide employment status, so all five complaints were declined for lack of jurisdiction; the merits were not decided.
