WRC finds operative’s unfair-dismissal complaint out of time

By Cathal Brosnan

Workplace Relations Commission ·

The WRC found an operative’s unfair-dismissal complaint was brought outside the time limit and was not well founded; the merits were not decided. Adjudication Officer John Walsh dated the decision 23 March 2017. The employer argued that the operative filed his complaint more than six months after his dismissal. His representative cited limited English, little support in Ireland and depression after the dismissal as reasons for the delay. The officer found the operative could communicate in English at work, could have sought free advice, and had not submitted medical certification to support the claimed depression. The officer concluded there was no basis to extend the time limit.
