The WRC awarded a locum consultant €6,000 after finding that a hospital breached his rights by repeatedly renewing fixed-term contracts without sufficiently precise and concrete grounds. The decision, dated 4 July 2017, also found he was entitled by law to a contract of indefinite duration from 1 June 2015. The consultant said he had done the same work without a break across successive contracts and was entitled to an indefinite duration contract after more than four years. The hospital argued that the contracts provided temporary cover for Consultants on secondment and that continued renewals were objectively justified. The adjudication officer found that the cover shifted between Consultants and could continue for an uncertain period. The stated grounds were not precise or concrete enough to justify the successive renewals.
