Agency worker’s unfair dismissal and notice complaints against supermarket fail

By Ruairí Dolan

Workplace Relations Commission ·

The WRC found that an agency worker’s unfair dismissal and minimum notice complaints against a supermarket were not well founded. The decision was dated 30 September 2017. The worker argued that the end of his supermarket assignment amounted to dismissal and claimed four weeks’ notice pay. The supermarket said he remained employed by the recruitment agency and that his assignment ended while he was on sick leave. The adjudicator found no evidence that the worker had been dismissed. In light of that finding, the related minimum notice complaint also failed.
