WRC awards worker €1,664 for unfair dismissal

The WRC awarded a worker €1,664 for unfair dismissal and ordered a further €556 net compensation for unpaid annual leave and statutory notice, in a decision dated 10 October 2016. The worker, a driver and bus escort on a community employment scheme, was dismissed after alleged misconduct. The WRC found the dismissal grossly unfair because the employer had no demonstrable procedure before dismissing him. The WRC also awarded €250 for an annual-leave complaint. A separate public-holiday complaint failed because the worker had received the entitlement during employment. Complaints about training-day pay, discrimination and health and safety were out of time; a victimisation complaint was not accepted. The bullying-procedure issue was considered as part of the dismissal complaint.
