The Workplace Relations Commission found that a worker was constructively dismissed by a distribution company and awarded her €15,528, equivalent to six months’ salary. The decision was dated 26 January 2016.
The worker said a meeting presented as a review turned into a discussion about ending her employment. The company said she resigned voluntarily after workplace relationships deteriorated and it began investigating her conduct.
The adjudicator found the company intended to end her employment at the meeting but had not told her its purpose in advance or given her time to prepare. The meeting was a serious departure from fair procedures, and the company’s actions had broken the trust between employer and employee. The adjudicator also suggested reviewing the company’s promotions policy.
