The Workplace Relations Commission dismissed two complaints by a sales director who argued his employment should have transferred to a food company under TUPE. The adjudication officer found that the redundancy decision was made independently of the transfer and was supported by economic, technical and organisational reasons. The company was losing €50,000 a week, and the officer found the director’s contract had ended after he accepted payment in lieu of notice, before the transfer date. The officer found he was not employed by the transferor when the transfer took place and was therefore not eligible to transfer under the regulations. The decision was dated 5 April 2017.
