WRC dismisses sales director’s two complaints over company transfer

By Niamh Kearney

Workplace Relations Commission ·

The Workplace Relations Commission dismissed a sales director’s two complaints against a food company over a business transfer, finding that the transfer did not cause his redundancy and that he was no longer employed by the company when the transfer took place. Adjudication officer Pat Brady found that the company’s receivers had independent business reasons to make the sales director redundant, including the need to reduce costs. His employment ended on 29 October 2015 after he accepted payment in lieu of notice; the transfer took place on 12 December 2015. The decision was dated 5 April 2017.
