The WRC dismissed two complaints by a sales director who argued that his employment should have transferred with a business. The decision was dated 5 April 2017. The director said his employment continued through his three-month notice period. The receiver said the business was losing money and his role was made redundant as part of cost-saving measures. The WRC found that the business transferred on 12 December 2015, but that the redundancy decision was independent of the transfer and supported by business reasons. It also found that the director’s contract allowed payment instead of working his notice, which he accepted, ending his employment on 29 October 2015. He was therefore not employed by the transferor on the transfer date and was not eligible to transfer. Both complaints were dismissed.
