WRC recommends binding arbitration in worker’s dispute with employer

By Saoirse Doyle

Workplace Relations Commission ·

The Workplace Relations Commission recommended that a worker and her employer refer their workplace dispute to binding arbitration, with agreed terms of reference covering all aspects of her employment. The process was to be completed within two months of the recommendation, dated 24 January 2017. The worker said her employer had not adequately addressed difficulties with a colleague. The employer disputed that a valid trade dispute existed and said an investigation did not support her bullying and harassment complaint. The adjudicator found that the employer knew of the difficulties, that its steps had not resolved them, and that the investigation had been delayed and had not followed the employer’s procedures.
