WRC dismisses laboratory manager’s penalisation complaint; four complaints withdrawn

The WRC dismissed a laboratory manager’s penalisation complaint against a consulting company, finding that the alleged penalisation was not proven and no direct link was established. The decision was dated 14 November 2017. The manager alleged that he was overworked and excluded from management after seeking restoration of earlier terms. The company denied penalisation and said it had addressed his travel concerns and changed his project and reporting arrangements with his agreement. The adjudicator found no evidence that revenue had been shifted to undermine the manager or that the evidence established a breach of the statutory working-hour limit. Four other complaints, concerning transfer of undertakings, working time, employment terms and industrial relations, had been withdrawn.
