WRC finds employee’s dismissal and fixed-term work claims fail

By Gráinne Nolan

Workplace Relations Commission ·

The WRC found an employee’s unfair dismissal, fixed-term work and working-time claims not well founded in a decision dated 26 July 2017. The employee said an educational institution had denied him a contract of indefinite duration and owed annual leave and public holiday pay. The institution said he had voluntarily agreed to end his employment and received paid leave during college closures. Adjudication officer John Tierney found the employee had voluntarily agreed to terminate his employment, so his unfair dismissal and fixed-term work claims failed. The officer also found that paid leave during college closures meant the institution had not breached working-time rules. The redundancy and payment of wages complaints were withdrawn.
