WRC rejects mushroom farm worker’s constructive dismissal claim

By Aoife Loughran

Workplace Relations Commission ·

The Workplace Relations Commission rejected a mushroom farm worker’s constructive-dismissal claim, finding that the employer’s conduct was not so unreasonable as to justify her resignation. The decision was dated 6 December 2016. The worker said she was pressured to resign after a dispute over alleged destruction of mushrooms and disciplinary action. The employer said she resigned voluntarily after the disciplinary process. The adjudication officer noted communication difficulties and said the employer could have made more effort to respond to a message from the worker’s daughter. The officer found that the worker had not used the offered grievance process and had not met the burden of proof for constructive dismissal. The unfair-dismissal complaint was not upheld.
