Workplace Relations Commission ·

The Workplace Relations Commission upheld a worker’s redundancy, minimum-notice and holiday-pay complaints against a hotel in a decision dated 18 April 2017. It ordered statutory redundancy based on weekly pay of €373.30 and continuous service from 20 September 2008 to 1 July 2015, along with €1,493.20 for four weeks’ notice and €2,413.36 in unpaid annual leave pay. The worker said his hours were cut before he was made redundant and that he received neither notice nor payment for accrued leave. The hotel disputed that it was the employer but did not attend the hearing. The adjudicator found it was the employer, relying on an RP50 form, an agreement and other evidence. The time limit was extended for the minimum-notice and wages complaints. The Unfair Dismissals Act complaints and the complaint against the other respondent were withdrawn.
