The WRC found six complaints by an employee against a cleaning company were not well-founded, in a decision dated 26 January 2017. They concerned whether the change of cleaning contractor transferred the employee’s job under TUPE, unfair dismissal, redundancy and minimum notice. The first contractor said the service transferred; the new contractor disputed that any undertaking, assets or employees had transferred. The adjudicator found there had been no transfer of undertaking, saying the loss of a service contract alone did not establish one. All six complaints in this decision were dismissed.
