Worker awarded €750 over missing employment terms statement

By Eimear Byrne

Workplace Relations Commission ·

The Workplace Relations Commission awarded a worker €750 after finding his employer had not provided the required statement of employment terms. His constructive dismissal claim failed, and a separate working-time complaint was withdrawn. The decision was dated 9 September 2016. The administrative assistant said workplace treatment and events around annual leave and a February encounter led him to resign. The training organisation denied adverse comments and said no formal grievance meeting or warning that his job was at risk occurred. The adjudication officer found the February encounters were not a formal grievance meeting. On constructive dismissal, he said the worker could have clarified or contested the possibility his employment might end, or waited for confirmation. The officer found no evidence the required terms statement had been provided and awarded €750.
