The WRC recommended that an employer cease further wage deductions until it clarified an alleged overpayment of annual leave pay. The recommendation was dated 19 October 2016. The worker had taken four weeks of leave in February 2015. On his return, he was told he had been overpaid and needed to repay a week’s wages. He disputed the calculation and asked for a breakdown, which he said he did not receive. The adjudicator said the employer could recover any overpayment, but the worker was entitled to question it and receive the requested information. If an overpayment was established and money remained due, the parties were recommended to agree repayment terms within four weeks.
