WRC awards butcher €5,967 redundancy pay after finding service continued

By Orla Quinn

Workplace Relations Commission ·

The WRC awarded a butcher €5,967 in statutory redundancy pay after finding his service continued through a change of business ownership. Adjudication Officer Gaye Cunningham dated the decision 7 June 2016. The butcher said he had worked for the business since 2009 and was told it was closing in October 2015, but was refused redundancy because he had worked for the new employer for less than two years. The retail outlet said the previous owner’s widow closed the business in her husband’s name and reopened it under a new employer registration number, and denied liability. The officer found an automatic transfer of undertakings and continuous insurable employment since 9 September 2009.
