WRC awards employee €12,000 over constructive dismissal

Workplace Relations Commission ·

The WRC awarded an employee €12,000 after finding she was constructively unfairly dismissed. The decision was dated 10 August 2016.

The employee said she resigned during a disciplinary process over write-offs because the same firm principal who raised the allegations also investigated them and was to oversee the hearing. The company said it had investigated escalating write-offs, suspended her on full pay and offered fair procedures.

The adjudication officer accepted that the company could investigate, but found there was no written policy and that the principal held overlapping roles in the process. The officer said the procedure undermined the employee’s confidence and ordered compensation because the employment relationship had irretrievably broken down.
