The Workplace Relations Commission awarded a worker €20,000 after finding he was unfairly selected for redundancy by a contract cleaning company. The decision was dated 25 July 2016.
The company said it had lost contracts, needed to restructure and used a last-in, first-out approach to select staff. The worker said others continued doing his job after he was made redundant.
The WRC found the redundancy decision had been made before the worker was told, there had been no consultation, part-time staff were excluded from the selection considerations and alternatives such as a three-day week were not discussed. It upheld the unfair dismissal complaint and ordered €20,000 compensation.
The holiday pay complaint was not well founded: evidence showed the worker had been paid for 16.15 days of leave, with no further payment due. A third complaint under the Industrial Relations Act was withdrawn because it had been submitted in error.
