WRC upheld five claims by forestry contractor worker

By Orla Quinn

Workplace Relations Commission ·

The WRC upheld the worker’s Sunday-working, annual-leave, public-holiday, written-terms and unfair-dismissal complaints against a forestry contractor. In a decision dated 30 June 2016, it awarded €1,400 for the missing written terms, along with €1,200 for unfair dismissal, €900 for annual leave, €500 for public holidays and €200 for Sunday working. The contractor had already paid €542 in holiday pay, but the officer found that fell short of the amount due. The worker said he was dismissed after returning from holiday and could not reach his employer to clarify his job status. The contractor denied dismissing him and disputed the working-time complaints. The officer found the worker’s average 40-hour week did not mean he set his own hours. The payment-in-lieu-of-notice and minimum-notice complaints duplicated one another and were covered by the dismissal decision.
