The WRC recommended compensation of €1,500 for a part-time cleaner after finding that contractors breached transfer rules when her employment moved between them. The decision was dated 1 June 2016.
The cleaner worked for the outgoing contractor at an educational institute before most of the workforce moved to the incoming contractor, continuing the same work for the same customer without a break. The adjudicator found the transfer was covered by TUPE rules.
The WRC recommended that the outgoing contractor pay €500 for failures concerning information and consultation. It recommended that the incoming contractor pay €500 for failing to communicate about the transfer and €1,500 for requiring her to sign a new contract with a July 2015 start date. The incoming contractor was also told to confirm that her employment, accrued leave and service from 9 January 2015 transferred. The working-time complaint against the outgoing contractor had no claim; the complaint against the incoming contractor was not well founded, and the notice complaint was not well founded.
