The WRC upheld a worker’s claim for redundancy and minimum notice payments, awarding €3,853.63 after finding her employment was continuous and the business identity had remained the same. The decision was dated 30 March 2016. The worker said she had received neither redundancy pay nor minimum notice when her employment ended. The employer’s representative said the former owner had died, the business had closed and reopened in his wife’s name, and debts left the estate unable to pay. The WRC found that the worker had more than four years’ continuous service and would have been protected by transfer of undertakings rules. It declared that €3,152.97 in statutory redundancy pay and €700.66 in minimum notice pay should be paid.
