The WRC found that a former company director and minority shareholder qualified for a statutory redundancy lump sum. In a decision dated 1 June 2016, adjudication officer Kevin Baneham said she was an employee despite her 11% shareholding and board role. The worker had been an administrative assistant for an organic produce company. The company did not attend the hearing. The adjudicator found that she reported to a manager, supplied her labour and carried no financial risk, and that her directorship and shareholding did not change her employment status. The WRC found that she was dismissed by redundancy and entitled to a lump sum based on her service from 7 January 2013 to 9 October 2015 and weekly gross pay of €188.19.
