WRC awards service technician €4,000 for constructive dismissal

By Donal Gilhooly

Workplace Relations Commission ·

The WRC awarded a service technician €4,000 after finding that his resignation from an energy service company amounted to constructive dismissal. Adjudication officer Gerry Rooney dated the decision 26 April 2016. The technician said he received no written outcome to a grievance about his manager and later faced disciplinary allegations that were not upheld. He said the relationship worsened and he felt he had no choice but to resign. The company did not respond or attend the hearing. The adjudicator found the company had not properly handled the grievance or confirmed in writing that there was no case to answer. It took no meaningful action, and the technician could not reasonably be expected to trust the employment relationship going forward. The WRC found it was reasonable for him to resign and awarded €4,000 under the Unfair Dismissals Acts.
