The WRC found that a hair salon unfairly dismissed a hairdresser and failed to provide him with a written statement of employment terms, awarding €2,328. The decision was dated 30 June 2016. The hairdresser had also withdrawn his redundancy complaint.
The salon said the hairdresser was an apprentice whose four-year training had ended, with no job available. The adjudicator found he was not an apprentice and preferred his evidence that he had not received the unsigned contract presented at the hearing. The salon was found in breach of the Terms of Employment (Information) Act.
The WRC also upheld his unfair dismissal complaint, finding the salon could not rely on the end of a fixed-term contract because it did not exclude the Act. The €2,328 was the combined redress for both successful complaints; the decision describes the contract breach award as two weeks’ remuneration and the dismissal award as four weeks’ remuneration. The hairdresser sought no lost earnings.
