The Workplace Relations Commission rejected a chef’s claims of race discrimination, dismissal because of race, harassment and victimisation by a restaurant. The decision was dated 11 May 2016. The chef alleged that a manager used a racial insult after he raised workplace concerns and said his treatment culminated in dismissal. The restaurant denied the name-calling and said employment ended after workplace difficulties. The officer found the chef had not established facts supporting an inference of race discrimination. The victimisation claim failed because there was no evidence he had complained to the restaurant about discrimination. The officer also found he had not established that race motivated his dismissal, and that he had not established that harassment occurred.
