WRC had no jurisdiction over interpreter’s working-time complaints

By Ruairí Dolan

Place: no local area assigned from the source.

The WRC found it had no jurisdiction over a worker’s two working-time complaints because there was no employer-employee relationship. The worker did not attend the hearing; the merits were not decided. In a decision dated 18 August 2016, Adjudication Officer Eugene Hanly found there was no mutuality of obligation, control or integration, and that the worker was in business on her own account. The employer said it engaged independent interpreters who invoiced for their work and handled their own tax and PRSI.
