In 1999, the Labour Court upheld a recommendation that Rushbrooke Lawn Tennis & Croquet Club Limited pay a bar assistant £8,000 in severance. It disallowed the appeal. The decision was dated 21 September 1999.

The worker resumed work on 1 March after a return-to-work agreement and was dismissed two days later. The club argued that she had failed to honour the agreement and said its financial position would make a lump-sum payment difficult. Mandate said severance should compensate for the loss of employment and should not require the worker to give up separate legal proceedings.

The Rights Commissioner had found that the worker made a major contribution to the termination of her employment, but recommended the payment as compensation for the loss of her job. The Labour Court upheld that recommendation and disallowed the club’s appeal.
