The Labour Court rejected an appeal by the Services Industrial Professional Technical Union over a worker’s claim for the higher non-resident crossing keeper’s rate at Nicholstown level crossing. The decision was dated 20 September 1999. The union argued that the worker had acted as a non-resident keeper while assisting her father and should have received the higher rate. Iarnrod Eireann said they were resident keepers, shared 24-hour cover and that the worker had been paid the correct resident rate. The Court found that the residency arrangements had not been broken and upheld the Rights Commissioner’s recommendation that the claim fail.
