The Labour Court recommended that Dairygold Cooperative Society Ltd use 1994 as the retrospective date for any upgrade to a worker’s job, amending a Rights Commissioner’s recommendation. The decision was dated 11 June 1999. The Services Industrial Professional Technical Union had appealed, arguing that retrospection should run from 1985, when the worker sought an upgrade and began carrying out the disputed duties. Dairygold had offered 1996 as the date. The Court said the inclusion of those duties had been conditional on accepting 1996, but recommended moving the date back to 1994.
