In 1999, the Labour Court disallowed the Irish Municipal, Public and Civil Trade Union’s appeal over a worker’s unsuccessful applications for promotion at Dublin Institute Of Technology. The Court dated its decision 30 March 1999 and affirmed the Rights Commissioner’s recommendation that the failure to upgrade the worker was not unfair or contrary to an agreement. The Court accepted that the agreed appointment process had been followed and found no evidence of manifest unfairness. It also recommended that the Institute promptly discuss the worker’s future career development.
