The Labour Court varied a Rights Commissioner’s recommendation in a career break dispute involving An Bord Altranais, finding that the Board had not met an obligation arising from the worker’s career break. In a decision dated 6 January 1999, it recommended Grade 7 remuneration and benefits for her from October 1995, on a personal basis. The Irish Municipal, Public And Civil Trade Union said the worker had returned to a Grade 5 post temporarily, pending a Grade 7 vacancy. The Board said the finance officer’s post had been permanently filled and there was no Grade 7 vacancy. The Court upheld the worker’s appeal and rejected the Board’s appeal, amending the start date in the earlier recommendation.
