In 1998, the Labour Court disallowed the union’s appeal and affirmed a Rights Commissioner’s recommendation that the worker and the Services Industrial Professional Technical Union (SIPTU) accept Aer Lingus’s position. The decision was dated 30 November 1998. SIPTU said the worker had performed the duties of a Super/Senior Operative B foreman for seven months and should be appointed to the grade or retain its pay. Aer Lingus said he had not acted up and that management performed the duties until the post was filled. The Court found no basis to reverse the recommendation.
