The Labour Court rejected Mandate’s appeal and upheld a Rights Commissioner’s recommendation that the dismissal of a sales assistant was fair. The decision was dated 24 June 1998. Duffy Group employed the worker at its Londis store in Blakestown, Dublin. It dismissed her after investigating till discrepancies and stock losses. Mandate argued she had no meeting with management and no chance to answer the allegations. Duffy Group said its investigation was complete before she returned from holidays, and claimed she had admitted larceny to Gardaí and later pleaded guilty at a civil court hearing.
