Labour Court upholds re-engagement recommendation in Abakin dispute

In 1998, the Labour Court upheld a Rights Commissioner’s recommendation that a worker be re-engaged after a dispute over the end of his employment with Abakin Limited. The decision was dated 21 January 1998, and the Court dismissed both parties’ appeals. The worker said the company had withdrawn his work, effectively making him redundant. The company said he had become unwilling to perform his duties and denied dismissing or making him redundant. The Court found fault on both sides. It considered that the worker was not prepared to carry out his duties as before, while the company’s refusal to provide work had made his dismissal inevitable.
