The Labour Court rejected the Services Industrial Professional Technical Union’s appeal for an unnamed Office Of Public Works worker over the calculation of his redundancy package. The decision was signed on 1 October 1997. The union argued that the package should have been calculated at the acting foreman rate after the worker chose redundancy when the Boyle Drainage Scheme ended. The OPW said the assignment had been temporary and that the package already accounted for his acting-up earnings. The Court disagreed with the Rights Commissioner’s description of the claim as opportunistic but otherwise upheld the recommendation that it fail.
