In 1997, the Labour Court upheld a worker’s appeal and found that Globetrotters Tourist Hostel unfairly dismissed her. It recommended £150 compensation, including £50 in addition to the £100 already paid. The decision was signed on 5 September 1997.
The worker serviced dormitory rooms from May 1996 until her dismissal in January 1997. She said the dismissal followed her enquiry about Social Welfare contributions and that she had been given no reason. The hostel said she was employed temporarily, had received verbal warnings about her work and had refused particular shifts.
The Rights Commissioner had found the dismissal was not unfair and recommended £100 as a goodwill settlement, which was paid and accepted. On appeal, the Labour Court said there was insufficient evidence to support the conclusion that the hostel had reasonable grounds for dismissing her. It found the dismissal unfair and recommended £150 in total, £50 more than the payment already made.
